GENERAL TERMS AND CONDITIONS OF SALE
1) INTRODUCTION
These terms (the "General Terms and Conditions of Sale") of Compar S.p.A., headquartered at Via A. Volta 6, 35010 Limena (PD), Italy (REA registration number 53356 and VAT number 00362520280) (the "Company") govern:
The offer and sale of products on the website www.bata.com/pt (the "Website") to the Company's Customers.
- Each order implies full and complete acceptance of these General Terms and Conditions of Sale. It is recommended to carefully read the General Terms and Conditions of Sale before purchasing the products. The Company reserves the right to modify these General Terms and Conditions of Sale at any time without prior notice. The version applicable to the Customer's order is the one available on the Website at the time the order is placed.
2) PURPOSE
The General Terms and Conditions of Sale govern the offer and sale of products to Consumers on the Company’s Website. They apply exclusively to products delivered to customers in Ireland.
A) OFFER AND SALE OF PRODUCTS ON THE WEBSITE
A1) DELIVERY OF PRODUCTS PURCHASED ON THE WEBSITE
If the product is available, the order will be confirmed, and the product, carefully packaged, will be delivered to the address provided by the Customer. If the requested product is unavailable, the Customer will be notified promptly, and the order will be canceled. Delivery to the Customer's specified address will occur without undue delay, approximately within five business days from the order confirmation date. However, the Company shall not be held responsible for delays.
If, for any reason, the Company cannot provide the purchased product, the Customer will receive a notification informing them of the cancellation. In this case, the Customer will receive an automatic refund for the amount paid (including shipping costs) within a few days of receiving the cancellation notification.
For orders with multiple products, the unavailability of one item will not hinder the delivery of available items. The Company will only ship the available product(s) and cancel the unavailable product(s).
The Customer shall not claim any cancellation compensation except for the refund of the price paid for the canceled portion of the order and any shipping fees.
A2) SHIPPING FEES
Shipping via BRT, DPD, and UPS:
- Free for orders above €60.
- €9 for orders of €60 or less.
BRT or DPD will make one delivery attempt and redirect the package to the nearest pickup point if the recipient is unavailable. If no pickup point is within a 10 km radius, a second delivery attempt will be made the following day.
Notifications will be sent via email or SMS in case of absence. Customers must provide accurate contact details to ensure successful delivery.
If the package is sent to a pickup point, the recipient will receive a notification indicating the location. The package will be held for five days for collection before being returned to the sender.
UPS delivers during business hours from Monday to Friday, excluding public holidays. After a failed delivery attempt, the package will be sent to the nearest UPS access point (check: https://www.ups.com/dropoff?loc=en_PT). if UPS is available in your area. You will receive a UPS InfoNotice notification.
To collect your order at the UPS access point, you must present yourself with a valid identity document. If you cannot personally retrieve the package, you can authorize another person to collect it, who will need to bring the following:
- A written authorization
- Your valid identity document
- A copy of your valid identity document
If the package is not collected within 10 days, it will be returned to the warehouse, and the order will be refunded.

Indicate an address where the delivery person can find someone to receive the package upon delivery. If the customer cannot receive the package at their home, please provide the address of a trusted person (parents, friends) or, if possible, a workplace. At the time of delivery, we recommend verifying that the package and the tape used by the Company for sealing are in good condition and have not been tampered with. The customer has 14 calendar days from the delivery date to file a claim if the package is damaged or altered, by contacting UPS customer service directly: https://www.ups.com/pt/en/support/contact-us.page.
You can track the shipment's progress using the tracking number on the UPS website https://www.ups.com/pt/en/home by accessing the shipment tracking option.

Indicate an address where the delivery person can find someone to receive the package upon delivery. If the customer cannot receive the package at their home, please provide the address of a trusted person (parents, friends) or, if possible, a workplace. At the time of delivery, we recommend verifying that the package and the tape used by the Company for sealing are in good condition and have not been tampered with. If this is not the case, we recommend signing the delivery receipt with a reservation, explicitly stating the observed damages or handling issues.

The shipment is made to the address you provided in the order. We, therefore, recommend specifying your address details very accurately:
- First and last name or the company name as indicated on the intercom
- Address: street, square, etc., without abbreviations
- House number: always include it; otherwise, write "s/n."
- ZIP code: specify the postal code for your city or district
- City: indicate the city name and, if possible, your district
- Province: indicate your province abbreviation
- If the order is not collected within the specified timeframe, the contract will be considered terminated.
A3) PRICES AND PAYMENT METHODS
The product prices, expressed in euros and inclusive of VAT, are valid at the time of order placement. Changes in VAT rates may be reflected in the price immediately. The total amount (including applicable shipping fees) is displayed on the order confirmation page.
Accepted payment methods:
- PayPal
- Credit card (Visa, Mastercard, Maestro)
- Google Pay
- Apple Pay
- Klarna
For payment methods, the Company uses the payment system of the entity managing the payment, through which it will only authorize the debit of the purchase amount. Regarding the use of these payment methods, it is not intended for the buyer to pay in accordance with the applicable national regulations.
A4) PAYMENT SECURITY
The site is equipped with a protection system. Banking details are encrypted and secured using SSL encryption to ensure absolute confidentiality. Your banking details will not be accessible to third parties on the Internet. Therefore, you must enter your credit card number for each new order.
A5) RIGHT OF WITHDRAWAL
5.1 The Customer has the right to withdraw from the contract concluded on the Site, without any penalty and without having to specify the reason, by returning to the Company all or part of the products purchased, in their substantial integrity and original packaging. The Customer must inform the Company of his intention to exercise his right of withdrawal within 30 days from the day on which the Customer or a person designated by him (other than the carrier) took possession of the products. If several products were purchased in the same order, the 30-day period begins to run from the date of delivery (possession of the products) of the last item received. After having communicated his intention to withdraw, the Customer will have an additional 14 days to return the products to the seller via a carrier.
Returns are at the expense of the customer.
Products purchased within the same order may be returned at different times, provided that the return deadlines guaranteed by the Company are respected.
Before handing over the products to the carrier for their return, the Client must follow the procedure below:
- 1. Access the "My Account" or "Track My Order" section.
- 2. Select the items they wish to return.
- 3. Once the items are selected, they will receive an email containing all the instructions for completing the return.
As an alternative to the above procedure, the Client may submit to the Company any other explicit declaration expressing their intention to exercise their right of withdrawal.
The Client can write to help.pt@bata.com and, at the same time, request the "withdrawal form."
The "withdrawal form," printed and duly completed by the Client (or another written declaration), must be included in the parcel with the goods.
In this case, the return shipment will be the Client's responsibility, both in terms of costs and risks.

The Client must return the goods within 14 days from the date they communicated their decision to withdraw from the contract.
To comply with this deadline, the goods are considered returned once they are deposited at the post office (the postal stamp serves as proof) or handed over to the carrier.
The shipment is under the responsibility and at the expense of the Client, covering both costs and risks.Items purchased online cannot be returned or exchanged in Bata physical stores.
Consequently, store personnel are not obligated to provide after-sales service for online purchases.

5.2 Once the product is received at the warehouse and its integrity is verified:
The company will only refund the price of the product itself within 14 days.
Shipping costs for the return or initial delivery will not be refunded.
Refunds will be issued using the same payment method used for the purchase.
Product Condition Requirements:
Returned items must not have been used, worn, washed, stained, damaged, or show signs of use.
Original tags must remain attached for clothing. Shoes must be returned in their original box.
A7) ORDERS CAN ONLY BE PLACED BY ADULTS.
4) WARRANTY
The purchase is subject to the provisions of Legislative Decree No. 206/2005 (Consumer Code) and its subsequent amendments.
The warranty applies only to products with conformity defects.
The warranty cannot be claimed in cases of: Negligence during use.
Improper maintenance or misuse of the product.
5) APPLICABLE LAW
If informed and aware of art. 14 of EU Regulation 524/2013 in accordance with EU Directive 11/2013 on out-of-court dispute resolution only, the consumer can file a complaint or request a direct consultation with the seller by collecting the European payment form for out-of-court dispute resolution, so-called. ODR (Online Dispute Resolution), accessible via the following link: https://ec.europa.eu/consumers/odr.

6) DATA PROCESSING INFORMATION
Information on the Processing of Personal Data Pursuant to Article 13 of European Regulation No. 679/2016 on the Protection of Natural Persons with Regard to the Processing of Personal Data (GDPR) and Article 13 of Legislative Decree 196/2003 - Personal Data Protection Code
Data Controller
The Data Controller of the participant's personal data is Compar S.p.A., headquartered at Via A. Volta 6 - 35010 Limena (PD), Italy, VAT number 00362520280.
The Data Controller ensures the strictest confidentiality regarding the processing of personal data in compliance with current regulations on personal data protection.
Specific security measures are implemented to prevent data loss, unauthorized or unlawful use, and unauthorized access.
Purpose of Data Processing
The personal data of the data subject will be processed strictly for purposes related to the purchase of the product, specifically:
a. Managing and executing the contractual relationship and ensuring compliance with it;
b. Fulfilling obligations established by laws, regulations, EU legislation, and instructions issued by authorities and regulatory bodies.
Recipients of Data Processing
The data will not be disclosed but may be accessed, to the extent necessary and for the purposes indicated, by employees and collaborators acting as data processors or handlers. It may also be shared with third parties, such as companies within the Bata Group in Italy and Europe, suppliers, couriers, banks, and companies that process data on behalf of the Data Controller. These entities, used by Compar S.p.A. to manage contractual relationships or for organizational needs, have been designated as Data Processors.
The Data Controller ensures that any transfer of data outside the EU will comply with Articles 44 and following of the Regulation and applicable legal provisions, including, if necessary, agreements ensuring an adequate level of protection.
Types of Data Processed
The Controller processes the personal data necessary for the purchase of the product, in particular, the name and surname, contact data, such as email address and mobile phone number, residential or home address.
The Controller may also store cookies, as further described in the Cookie Policy.
Method and Duration of Processing
The data, as well as the information relating to the order, will be kept for the time necessary to provide assistance and support in the event of a return and/or to resolve any problems related to the order and, in general, for the management and execution of the contractual relationship and the corresponding compliance with the obligations provided for by laws, regulations, EU legislation, as well as by the instructions given by the authorities and supervisory bodies.
Rights Under Articles 7 of the Code and 15, 16, 17, 18, 20, and 21 of the Regulation
The subjects to whom the personal data refer have the right to obtain, at any time, confirmation of the existence or non-existence of such data and confirmation of their processing or not, to know their content and origin, to verify their accuracy, or to request that they be integrated, updated, or corrected. They also have the right to request the deletion, anonymization, or blocking of data processed in violation of the law, as well as to object to their processing in any case, for legitimate reasons.

Similarly, it should be noted that the Data Subject has the right to withdraw their consent at any time, without affecting the legality of the processing based on the consent given before the withdrawal, without prejudice to the consequences outlined below regarding the refusal to provide such personal data.
The Data Subject may exercise their right to file a complaint with a supervisory authority.
The provision of data is optional. However, failure to provide the requested data may result in the inability to establish or continue the contractual relationship, in whole or in part, and to respond to requests for service provisions.
